In these Terms and Conditions, the terms “TestsCareers”, “we”, “us”, and “our” refer to the operators of the platforms listed above. By accessing any of our websites or using our services, you agree to be bound by these Terms and Conditions (“Terms”).

We reserve the right to update, modify, or replace any part of these Terms at any time by posting changes on this page. Continued use of the platform following such changes constitutes acceptance of those changes.

1. Use of the platform and user eligibility

To access our services, you must be of legal age in your country of residence or have obtained permission from a parent or legal guardian if you are a minor. You are solely responsible for ensuring that your use of our platforms complies with all applicable laws and regulations in your jurisdiction.

Accounts created on our platforms are intended for personal and non-commercial use only. Each account is strictly personal. You may not share your login credentials, grant access to unauthorized third parties, or distribute our content in any form. Any violation may result in immediate account termination without refund and may lead to legal action.

You also agree not to use the platform for any unlawful purpose or in any manner that could damage, disable, overburden, or impair our servers, or interfere with other users' experience.

2. Refund policy – 14-day money-back guarantee

By purchasing and accessing digital content on our platform TestsCareers, you expressly consent to the immediate performance of the service and acknowledge that such access waives your right of withdrawal, in accordance with Article 16(m) of the European Consumer Rights Directive (2011/83/EU).

We aim to provide a high-quality experience across all our platforms. However, we understand that some users may not be satisfied. For this reason, we offer a 14-day money-back guarantee under certain conditions.

Eligible refund cases

A refund request will be reviewed and processed within five business days if it meets one of the following criteria:

1. Verified technical issue: If you were unable to access your account or the platform due to a technical issue on our side, and our support team was unable to resolve it within 96 hours of your initial contact, a full refund will be issued.
2. Significant content discrepancy: If you believe that the content provided is materially different from that used in a real assessment by an employer or within a specific industry, you may submit a reasoned request supported by examples or evidence.
   • If our team confirms that the discrepancy is substantial, a full refund will be granted.
   • If the discrepancy is considered partial or moderate, a partial refund of 25% to 50% may be granted.

Non-eligible refund cases

No refund will be granted in the following cases:

• You found the questions too easy or too difficult
• You failed an official test
• You changed your mind or signed up by mistake
• You expected access to exact employer test content
• You identified an error in a question or explanation
• You did not use the platform during the refund period
• Any reason not explicitly listed under “Eligible refund cases”

Content authenticity disclaimer: Our platform TestsCareers provides training tests designed to help improve your performance in real assessments. These simulations are inspired by widely used formats and difficulty levels. However, we do not reproduce or distribute exact questions from employers, publishers, or official institutions.

Additional refund conditions

• Requests must be submitted within 14 calendar days from the date of purchase.
• Refunds apply only to individual users. Group or institutional accounts are excluded.
• We reserve the right to reject requests deemed abusive, repetitive, or fraudulent.

To request a refund, please use our contact form and include “Payment, billing or refund” in the subject line, along with your order reference and a detailed explanation.

3. Billing, Access and Account Information

By registering or making a purchase on one of our platforms, you agree to provide complete, accurate, and up-to-date account and billing information. Failure to do so may result in suspension of access or cancellation of your account.

We reserve the right to refuse or cancel any order at our sole discretion, including in cases of suspected fraud, unusual usage behaviour, or violation of these Terms.

Access to our platform TestsCareers is granted immediately after payment. Unless otherwise stated at the time of purchase, any paid access to tests and related content is valid for a period of 6 months from the date of purchase. Upon expiry of this period, the relevant access automatically ends without prior notice. Your login credentials are strictly personal and non-transferable. Simultaneous access from multiple devices or IP addresses may lead to security checks or temporary account suspension.

You are responsible for keeping your login credentials confidential and for all activity under your account.

4. Content and Intellectual Property

All content available on our platforms - including tests, questions, solutions, explanations, illustrations, and the overall site design - is the exclusive intellectual property of CoffeeStain LTD or its content partners.

You may not under any circumstances copy, distribute, publicly display, sell, resell, modify, publish, or use all or part of our content without prior written authorisation.

Any unauthorised use of content likely to infringe our intellectual property rights or those of our licensors will result in the immediate termination of your account and may give rise to civil or criminal proceedings.

Image Attribution

Certain visual content, including but not limited to icons, illustrations, and images used on this website, originates from Freepik. These assets are used in accordance with the licensing agreements and intellectual property rights of Freepik.

5. Platform Availability

We strive to ensure continuous accessibility of our platforms, but we cannot guarantee uninterrupted or error-free service. Temporary interruptions may occur due to scheduled maintenance, technical issues, or updates.

We reserve the right to carry out maintenance operations at any time, with or without prior notice. You acknowledge that temporary interruptions may occur and agree that we shall not be held liable for any loss, inconvenience, or disruption caused by such interruptions.

6. Accessibility, Disabilities, and Non-Discrimination

Our tests are simulations intended to expose you to a range of question formats, reasoning patterns, and difficulty levels. Your results in real assessments depend on many external factors beyond our control, including the nature of the actual test, your personal level of preparation, and testing conditions.

8. User Feedback and Content

We welcome user feedback in order to improve our services. If you voluntarily submit suggestions, comments, or any other content to us, you agree that we may use such materials without restriction. You undertake not to include in your feedback any confidential or protected information belonging to third parties.

You also agree that such submissions may be edited, copied, translated, published, or otherwise used by us without compensation or obligation, provided that such use remains lawful and appropriate.

9. Prohibited Uses

You agree not to misuse the platform. Prohibited activities include, without limitation: sharing or reselling your account, copying, reproducing, scraping, or extracting content, reverse engineering, uploading malicious code, using bots or automated tools, harassment, impersonation, or infringement of intellectual property, privacy, or confidentiality rights. Any such activity may result in the suspension or termination of your account and may also give rise to legal action.

10. Limitation of Liability

The services offered on our platforms are provided “as is” and “as available”, without any warranty, express or implied. To the fullest extent permitted by law, we disclaim all liability for direct, indirect, incidental, or consequential damages resulting from the use of our services or inability to access them.

11. Termination

You may stop using the platform at any time. We reserve the right to suspend or terminate your account, with or without notice, in the event of a breach of these Terms, fraudulent activity, or abuse of our services.

Termination of access does not entitle you to a refund unless your situation falls within the refund cases expressly provided for in these Terms.

12. Additional Legal Notice - Independence and Intellectual Property

The platforms operated by CoffeeStain LTD are independent services. Our services are not affiliated with, associated with, authorised by, or endorsed by any employer, official test publisher, certification body, public administration, ministry, academic institution, or any other governmental or private entity, unless expressly stated otherwise.

All product names, company names, logos, brands, trademarks, service marks, test names, and other identifiers mentioned on our platforms remain the property of their respective owners. Any reference to them is made solely for descriptive and informational purposes and does not imply any affiliation, endorsement, or approval.

13. Affiliate Program

If you choose to participate in our affiliate programme, your relationship with us in this context is governed by the Affiliate Program Terms. In the event of any inconsistency, the Affiliate Program Terms shall prevail.

14. Language

These Terms and Conditions may be translated into other languages. In the event of any discrepancy between a translated version and the original, the French version shall prevail and shall be considered the official and binding version.

15. Force Majeure

We shall not be held liable for any failure or delay resulting from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, labour disruptions, internet or telecommunications outages, or governmental restrictions.

16. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws in force in Be'er-Sheva, Israel. Any dispute falls within the exclusive jurisdiction of the competent courts of Israel.

18. Product Display and Accuracy

If the pending transaction remains unresolved for an unreasonable period and no contact is made with our support team, we reserve the right to refuse refund or cancellation requests relating to the original pending payment.

No automatic compensation shall be granted in the event of an error, omission, or inaccuracy, but we are committed to correcting verified issues as quickly as reasonably possible.

If you access our services via our mobile applications (Apple App Store or Google Play Store), you agree to comply with the terms of use of the relevant store. CoffeeStain LTD is responsible for the content, performance, and features of our Applications.

The app stores are third-party platforms and are not responsible for providing maintenance or support for our Applications beyond any obligations they may have under their own terms. You also agree to comply with all applicable third-party terms when using our Applications.
